They must also yield the right-of-way to vehicles already on the main road and to pedestrians that are so close that they pose an immediate hazard. When exiting a parking space, drivers must yield to vehicles and pedestrians as well. (s. 316.125, F.S.) Pedestrian's Right-of-Way at Crosswalks A pedestrian is anyone on foot but includes people using a mobility device such as a wheelchair, skateboard, or electric scooter. They always have the right-of-way at both marked and unmarked crosswalks at intersections! It doesn’t matter if the crosswalk has a signal light, a stop sign, or no sign at all. You must yield to pedestrians. (s. 316.130, F.S.) If pedestrians make eye contact with you, they are ready to cross the street. Give them space and allow them to cross safely. Allow older pedestrians, disabled pedestrians, and those with young children sufficient time to cross the street. If you are going to make a right turn, wait at the limit line (not in the crosswalk) for pedestrians to clear the sidewalk before making your turn. Even if you have a green light, you must allow pedestrians to cross first. Do not pass a vehicle that has stopped at a crosswalk. A pedestrian you cannot see may be crossing the street. Stop and proceed only when all pedestrians have crossed. KNOWING WHEN TO GIVE UP YOUR RIGHT-OF-WAY Right-of-way rules try to simplify the concept of right-of-way into black and white, easy-to-understand situations. They tell us which car should go and which car should wait. But even with all those rules, right-of-way situations still have many gray areas based on the driver's point of view. The way one driver sees a situation makes it obvious to him he should go ahead, and the way the other driver sees the situation makes it clear to her that she should go. They can't both go. So what do you do when you find yourself in this situation? Keep in mind that the ultimate goal when driving is not about being right or proving that the other driver was wrong. The goal is to avoid all collisions and keep everyone safe, even if it means giving up your right-of-way. Does it seem unfair to give up your well-deserved right-of-way to another driver?
